Terms and Conditions
The issuance of a Purchase Order (PO) by Buyer and TouchPoint Aviation’s acceptance of PO constitutes Buyer’s acceptance of the terms of TouchPoint Aviation’s commercial offer. If the offer is subject to a validity period, TouchPoint Aviation is bound by such offer until expiration of that period unless otherwise mutually agreed between the parties.
Return & Exchange
Return Policy: Equipment returned within thirty (30) days of delivery to Buyer will not be subject to any re-stocking fee assuming component has not been installed on an aircraft. Equipment returned after thirty (30) days will be subject to a fifteen percent (15%) re-stocking fee. Exchange Policy: 1. Core units not returned within thirty 30 day(s) of shipment of original unit will be subject to a second exchange fee. An additional 30 day(s) will then be allowed for return of the core unit. If core unit is still not returned after the 30 day extension, the unit will be subject to a third exchange fee. Units not returned after ninety (90) days will be considered as an outright sale and will be invoiced at the Outright Value. The original exchange fee and late fees will apply. 2. Prior authorization is required before a unit can be returned due to a failure. All original paperwork must be returned with the unit or the core will be considered unacceptable and all repair charges will be billed to Company. TouchPoint Aviation Services, LLC. will send the unit to the original repair facility for evaluation. If the unit is determined faulty, and within the warranty period, TouchPoint will manage the warranty claim process. If the shop advises "no fault found" (NFF) the Company is liable for all freight, shop evaluation fees including a 10% handling fee. 3. Company agrees to pay for the overhaul/modification/repair of the exchange core unit to bring the unit to the same configuration as the supplied unit, plus all transportation costs and a handling charge of 10% of the repair costs. If this repair service transaction is processed as a flat rate repair, and repair costs exceed 65% of the outright value or the repair station deems the core unit Beyond Economical Repair (BER), the aforementioned Outright Value will be billed. Core repair estimates will be submitted to Company prior to providing approval to TouchPoint Aviation Services, LLC designated repair station. Core repair estimates not approved by Company within five (5) calendar days will be deemed approved. 4. If prior approval is provided by TouchPoint Aviation Services, LLC to return the exchange core unit in the same condition and configuration as the supplied unit, the due date of the core unit will be 30 day(s) from shipment of the exchange unit. Core unit will be in New, Overhauled, Repaired or Serviceable condition and will be returned with the authorized release certificate from a TouchPoint Aviation Services, LLC approved repair station. In addition, in returning a tagged unit, your Company will be liable for any warranty claims for a period of six (6) months for SV components and one (1) year for OH components, which may arise out of the sale or exchange of said core unit by TouchPoint Aviation Services, LLC 5. In the event the component fails after the return date to TouchPoint Aviation Services LLC and within the warranty period, Company will be liable for any warranty claims. 6. Prior authorization is required before an unlike core is returned to TouchPoint Aviation Services, LLC. In the event an unlike core is returned without authorization, TouchPoint Aviation Services, LLC. will assess additional charges or the core may be rejected and invoiced for the Outright Value. A Core unit of different configuration standard will be modified at Company’s expense unless agreed upon by TouchPoint Aviation Services, LLC. in advance. 7. Any core unit missing the data plate or Incident Related will not be considered acceptable and will be billed outright. The core unit will be returned to the Company freight collect. 8. Core units returned must be within an equivalent range of likeness. The Date of Manufacture (DOM), Serial Number and Amendment Level of the core unit will be provided to TouchPoint Aviation Services, LLC. for evaluation and approval prior to returning the core unit. Time controlled core units must be equivalent to or less than the TSN/CSN of the supplied unit or Company will be subject to additional charges by TouchPoint Aviation Services, LLC. 9. Company is liable for any damages or loss occurring during shipment of core unit to TouchPoint Aviation Services, LLC 10. In the event the core is unacceptable to TouchPoint Aviation Services, LLC, the Company will be billed the aforementioned outright value as well as the original exchange fee, any accrued late fees, transportation and evaluation fees of the core unit. 11. Core units are to be returned to TouchPoint Aviation Services, LLC. via prepaid freight and must include: Non-incident statement from Company and the airline from which part is removed, Proof of trace from the airline via packing slip or a signed statement from the operator indicating part number and serial number. Approved core sources are: OEM or Aircraft manufacturer, FAA 121, 129 and 145 certificate holders. All core trace paperwork must be approved by TouchPoint Aviation Services, LLC. in advance. 12. Core Units will be returned to: TouchPoint Aviation Services, LLC. Attention: Core Returns. 813 Arnold Ave. Point Pleasant Beach, NJ 08742. Core units returned to any other location will be considered as unreturned and subject to the associated late fees. Company will also be invoiced for all transportation costs and a 10% handling fee to return the core unit to the correct location. 13. Company shall be liable for loss, damage or expense directly or indirectly arising from the installation, misuse or handling of the unit from any other cause. 14. Title of exchange units will change to Company upon receipt of both the exchange core unit by TouchPoint Aviation Services, LLC. and payment in full to TouchPoint Aviation Services, LLC. by the Company. Payment terms will be pre-determined. 15. The laws of the State of Florida shall apply to this Unit Exchange Agreement. The prevailing party in any legal action brought under this Agreement shall be entitled to legal fees. It is likewise agreed that a fax or electronic signature is acceptable and binding.
FOB TouchPoint Aviation
Unless otherwise offered, payments shall be made by wire, swift, bank transfer, check or credit card (with applicable fee). Payment terms considered upon review of credit and banking references.
The length and scope of the warranty offered is dependent on the condition of the component purchased. Standard warranty for New (NE) and Overhauled (OH) components is one year from delivery date. Standard warranty for serviceable (SV) components is six (6) months from date of delivery. Components purchased in As-Removed (AR) condition are guaranteed repairable.
